FlashTales Terms and Conditions

Welcome to FlashTales! These Terms and Conditions (the "Terms") govern your access to and use of the FlashTales app (the "App") and services provided by FlashTales LLC ("we," "us," or "our"). By using the App, you agree to these Terms. If you do not agree, please do not use the App.

1. Acceptance of Terms

By creating an account or using the App, you confirm that you are at least 18 years old or have the consent of a legal guardian. If you agree to these Terms on behalf of a minor, you are fully responsible for their compliance.

2. AI-Generated Content

2.1 Disclaimer

The stories and illustrations generated by FlashTales are created using artificial intelligence. While we strive for accuracy and appropriateness, we cannot guarantee that all content will meet your expectations or be free of errors, inaccuracies, or unintended offensive material.

2.2 Parental Review Responsibility

As a parent or guardian, you are responsible for reviewing all generated content to ensure it is suitable for your child before sharing. FlashTales disclaims liability for any consequences resulting from the use of generated content.

3. User-Provided Information

3.1 Data Collection and Usage

To personalize stories, we collect user-provided data such as children's names, ages, appearance descriptions, and other inputs. This information is used solely to create customized stories and enhance your experience with the App.

3.2 Data Privacy and Security

Your data is securely stored in our Supabase database and Amazon S3 buckets. We comply with all applicable data protection laws and use your data only as outlined in these Terms and our Privacy Policy.

3.3 Third-Party Services

We rely on trusted third-party services, such as Supabase for database management and Amazon S3 for file storage. These services adhere to industry-standard security practices. By using the App, you consent to the processing of your data by these third parties.

4. Intellectual Property

4.1 Ownership of Content

All content generated by the App, including illustrations, text, and audio, is for personal, non-commercial use only. FlashTales retains all rights to the generative algorithms and resulting outputs.

4.2 Prohibited Use

You may not reproduce, distribute, commercialize, or claim ownership of any content generated by the App without our express permission.

5. Data Retention and Deletion

5.1 Retention Policy

We retain your data as long as your account is active or as required to provide our services.

5.2 Data Deletion

You may request the deletion of your data at any time by contacting contact-us@flashtales.ai. Upon receiving your request, we will delete your data within a reasonable time, except where retention is required for legal, regulatory, or legitimate business purposes.

6. Liability and Warranty

6.1 Disclaimer of Warranties

The App is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.

6.2 Limitation of Liability

To the fullest extent permitted by law, our total liability for any claims arising from the App is limited to the greater of $50 or the amount you paid for the App in the three months preceding the event giving rise to the claim.

6.3 Offensive Content

Due to the nature of AI, the App may generate unintended or offensive content. FlashTales is not liable for emotional distress, reputational harm, or other damages arising from such content.

You agree to resolve disputes individually and waive any right to participate in class actions.
